  1. Section 43A of the Information Technology Act, 2000;
  2. Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);
  3. Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

 

We at INVC - Apna Family Vaccination Centre, (hereinafter mentioned as "INVC") are committed to protect our customers’ personal information and/or sensitive personal data and strive to maintain the privacy of your personal information.

For your information, “Personal information” is any information that can be used by itself to uniquely identify, contact, or locate a person, or can be used with information available from other sources to uniquely identify an individual. To this policy, sensitive personal data or information, such as medical history has been considered as a part of personal information.

“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, can identify such person.

The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

  • passwords;
  • financial information such as bank accounts, credit and debit card details or

 

other payment instrument details

 

  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • biometric information;
  • information received by body corporate under lawful contract or otherwise;
  • visitor details as provided at the time of registration or thereafter; and
  • call data records

 

The IT Act and the SPDI Rules regulate the collection, usage, retention, and disclosure of personal information, which is defined under the SPDI Rules as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, can identify such person.

You agree that you are providing all information, including SPDI to us voluntarily. Collection, use and disclosure of personal information and SPDI requires your express consent.

You are providing us with your consent to our use, collection, and disclosure of the personal information and SPDI. You may choose to not provide Us with personal information and SPDI, but if you do so, we will be unable to provide you access to our app or the site or deliver products or provide services through our platform.

 

Disclosure and Transfer of Personal Information

Internal Use: INVC and its employees may utilize some or all available personal information for internal assessments, measures, operations, and related activities.

Authorized Third Parties: INVC may have contractors or include third parties which are external to itself for strategic, tactical and operational purposes. Such agencies though external to INVC, will always be entities which are covered by contractual agreements. These agreements in turn include INVC’s guidelines to the management, treatment, and secrecy of personal information.

We may transfer your personal information or other information collected, stored, processed by us to any other entity or organization located in India or outside India only in case it is necessary for providing services to you or if you have consented (at the time of collection of information) to the same. You are providing your consent to contact you either via calls, SMS or emails, and for sharing your personal information in several ways, such as in writing, online, through "click-through" agreements; orally, including through interactive voice response; or when your consent is part of the terms and conditions pursuant to which we provide you service; or when you provide us a missed call for our marketing SMS campaigns. Please note, this will override DND signups.

We, however assure you that INVC does not disclose your personal information to unaffiliated third parties (parties outside INVC corporate network and its Strategic and Business Partners) which could lead to invasion of your privacy.

Government Agencies: We may also share your personal information with Government agencies or other authorized law enforcement agencies (LEAs) mandated under law to obtain such information for the purpose of verification of identity or for prevention, detection, investigation including but not limited to cyber incidents, prosecution, and punishment of offences.

We will be unable to provide you with access to our site, app or the services, as described under the Terms, and such modification may be regarded as the User seeking to discontinue his or her access to our site, app or the services.
